Immediate
suspension of driver's licence or permit in certain circumstances
Immediate suspension of drivers licence or permit in certain
circumstances is governed by section 51 of the Road Safety
Act;
1.
If you have a full drivers licence and have a reading of
0.15 or more
2. If you hold a learner permit or probationary driver licence-
and have a reading of 0.7 or more
3.
Refusal to undergo a breath test, refusal to undergo a drug
impairment assessment or a refusal to comply with certain
lawful requirements under the Act
4.
If the offence would be a subsequent conviction (within
the meaning of the Road Safety Act) if the person were convicted
The
effect of a section 51 notice (immediate
suspension of a driver's licence) is that the period of
disqualification that a Court gives you will be backdated
to the date of the notice.
A
person who has been given a notice of immediate
suspension of driver's licence can appeal
against that notice to the Magistrates Court.
The
person appealing against an immediate suspension must establish
exceptional circumstances exist which mean the Court should
cancel the order.
