Heidelberg Magistrates' Court is located on Jika Street, at the bottom of burgundy Street, Heidelberg as is the Heidelberg Children's Court.

What types of cases does the Heidelberg Magistrates Court hear?

Broadly speaking the Heidelberg Magistrates Court has three jurisdictions: civil, family and criminal.

 

The civil jurisdiction of the Heidelberg Magistrates Court hears a variety of matters including but not limited to, claims for personal injury damages, and contractual disputes. It also has the power to determine various civil applications brought by prosecution authorities acting pursuant to the Confiscation of Assets Act.

 

The Family Law Act (1974) empowers all magistrates courts, including the Heidelberg Magistrates Courts to hear and determine certain prescribed matters under that Act.

 

By operation of the Crimes (Family Violence) Act, the Heidelberg Magistrates Court has the power to hear and decide applications for the prevention of domestic violence.

Such applications are called Intervention Orders. Although the making of an order against a respondent does not amount to a criminal act, breaching an Intervention Order does.

For a first offence, a maximum fine of 240 penalty units, or 2 years imprisonment or both applies. For a subsequent offence, the Act prescribes a maximum of 5 years imprisonment.
